Hadith No. 14 of An-Nawawi

عن ابن مسعود رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم: “لا يحل دم امرئ مسلم إلا بإحدى ثلاث: الثيب الزاني، والنفس بالنفس، والتارك لدينه المفارق للجماعة”.

Phrase-by-Phrase Translation of Hadith No. 14

1. عن ابن مسعود رضي الله عنه قال: – On the authority of Ibn Mas’ud (may Allah be pleased with him), he said:
2. قال رسول الله صلى الله عليه وسلم: – The Messenger of Allah (peace and blessings of Allah be upon him) said:
3. “لا يحل دم امرئ مسلم – “The blood of a Muslim person is not lawful to be shed
4. إلا بإحدى ثلاث: – except in one of three cases:
5. الثيب الزاني، – the married adulterer,
6. والنفس بالنفس، – and a life for a life,
7. والتارك لدينه المفارق للجماعة”. – and the one who abandons his religion and separates from the community.”

Teachings of Hadith No. 14

This Hadith highlights the sanctity of a Muslim’s life and specifies the only three circumstances under which capital punishment may be applied in an Islamic state by a legitimate authority:

1. Sanctity of Muslim Life: The primary teaching is the great value Islam places on human life, making its unlawful taking a severe sin.
2. The Married Adulterer (الثيب الزاني): This refers to a married person who commits adultery. The prescribed punishment in Islamic law for this specific act is stoning to death, after due process and clear evidence.
3. A Life for a Life (والنفس بالنفس): This refers to the principle of retribution (Qisas) for murder. If a person intentionally takes another’s life, their life may be taken in return, provided the victim’s family demands it and a legitimate Islamic court passes the judgment.
4. The One Who Abandons His Religion and Separates from the Community (والتارك لدينه المفارق للجماعة): This refers to an apostate who not only leaves Islam but also actively works against the Muslim community, posing a threat to its security and stability. The punishment for such an act of treason in an Islamic state is death.
5. Judicial Authority: It is crucial to understand that these punishments can only be carried out by a recognised Islamic judicial system and not by individuals or vigilantes.
