Lesson Content/Board Summary

Land Use Act of Nigeria

Meaning of Land Use Act of 1978

The Land Use Act of 1978 is a Nigerian law that vests all land in the territory of each state of the Federation in the Governor of that state. It was enacted to nationalize land and ensure that all Nigerians have access to land, regardless of their social or economic status. The Act regulates land ownership, administration, and use across the country.

Key Features of the Land Use Act of 1978

The following are the major features of the Land Use Act:

  • All land in the territory of each state is vested in the Governor of that state.
  • The Governor holds the land in trust for the people and is responsible for its allocation and management.
  • The Act abolished all existing freehold and customary land tenure systems, replacing them with a leasehold system.
  • It introduced the Certificate of Occupancy (C of O) as the primary document of title to land, issued by the Governor for urban lands and Local Government for rural lands (Customary Right of Occupancy).
  • The maximum term for a Statutory Right of Occupancy (urban land) is 99 years, while Customary Right of Occupancy (rural land) has no fixed term but is subject to conditions.
  • Compensation is payable only for improvements on the land, not for the land itself, in cases of revocation of a Right of Occupancy.
  • No land can be alienated (sold, leased, mortgaged, assigned, or transferred) without the consent of the Governor.
  • The Act established Land Use and Allocation Committees (LUAC) at the state level and Land Allocation Advisory Committees (LAAC) at the local government level to advise the Governor on land management.

Need for Government to Enforce the Land Use Act and its Importance for Agriculture

The government needs to enforce the Land Use Act for several reasons, particularly its importance for agricultural development:

  • Promotes Equitable Land Distribution: It aims to make land available to all Nigerians for various purposes, including farming, reducing land hoarding by a few individuals.
  • Ensures Security of Tenure: The Certificate of Occupancy provides legal proof of land holding, giving farmers confidence to invest in long-term agricultural projects without fear of arbitrary eviction.
  • Facilitates Access to Credit: A valid C of O can be used as collateral to obtain loans from financial institutions, enabling farmers to access funds for farm development, equipment, and inputs.
  • Prevents Land Speculation: By vesting land in the state, the Act discourages excessive buying and selling of land for profit without productive use, making more land available for agriculture.
  • Encourages Planned Development: It allows for planned land use, enabling the government to designate specific areas for agricultural zones, thereby promoting organized farming.
  • Resolves Land Disputes: The Act provides a legal framework for resolving conflicts over land ownership and use, creating a more stable environment for agricultural activities.
