Lesson Content/Board Summary
ARTHUR RICHARDS CONSTITUTION OF 1946/47
Meaning of Constitution
A constitution is a body of fundamental principles or established precedents according to which a state or other organization is acknowledged to be governed. It outlines the powers of government, the rights of citizens, and the relationship between different arms of government.
Arthur Richards Constitution (1946/47)
The Arthur Richards Constitution was enacted in 1946 by Sir Arthur Richards, who was the Governor of Nigeria from 1943 to 1948. It came into effect on January 1, 1947, and replaced the Clifford Constitution of 1922. The constitution aimed to promote the unity of Nigeria and provide for greater participation of Africans in the discussion of their own affairs, though it was largely imposed without significant consultation with Nigerians.
Features of the Arthur Richards Constitution
The following are the main provisions of the Arthur Richards Constitution:
- It introduced regionalism by dividing Nigeria into three administrative regions: the Northern, Western, and Eastern Regions.
- It established Regional Assemblies (Houses of Assembly and Houses of Chiefs in the North) which were advisory bodies to the Governor.
- The Legislative Council was enlarged and had an unofficial African majority for the first time.
- The Governor retained significant powers, including the power of veto over legislation.
- It provided for a central Legislative Council that legislated for the whole country, including the Northern Region.
- Membership to the Legislative Council was through a combination of nomination and indirect election from the Regional Assemblies.
- It did not provide for universal adult suffrage; voting was restricted to a few eligible males in Lagos and Calabar.
Merits (Advantages) of the Arthur Richards Constitution
The following are the advantages of the Arthur Richards Constitution:
- It promoted the unity of Nigeria by bringing representatives from the North and South together in the Legislative Council for the first time.
- It introduced the concept of regionalism, which was a step towards a federal system of government.
- It increased the number of unofficial African members in the Legislative Council, allowing for more Nigerian input.
- It recognized and preserved traditional institutions through the establishment of Houses of Chiefs.
Demerits (Weaknesses) of the Arthur Richards Constitution
The following are the disadvantages of the Arthur Richards Constitution:
- It was largely imposed on Nigerians without adequate consultation or popular participation in its drafting.
- The Regional Assemblies created by the constitution were merely advisory and lacked real legislative powers.
- The Governor retained excessive powers, including the power to veto bills passed by the Legislative Council.
- It did not provide for universal adult suffrage, limiting political participation to a select few.
- The increased African representation had limited impact due to the Governor’s overriding powers.
- The regional divisions it created eventually fostered ethnic rivalries and regional loyalties over national unity.
